FRANCHISE CENTRAL SUES FRANCHISE COUNCIL OF AUSTRALIA (“FCA”)
Earlier this year, Franchise Central (Australia) Pty Ltd issued legal proceedings in the Supreme Court of Victoria against The Franchise Council of Australia (FCA).
The matter settled- the terms of which remain confidential.
However, the following clarification and apology was also produced as part of that settlement.
FCA clarification and apology:
"In the February 2008 issue of FCA update, the link to an article titled “Franchise & Small Business News – BRW reference to the following story: “Know when to bail out: A rogue consultancy turns a business dream into a nightmare”.
The text was provided to the FCA by the publisher of the BRW Fast Franchises edition and was not text prepared or authored by the FCA. The text made a reference to the article “From building to bail out – An agreement with a consultancy form to help expand a franchise business led to claims of high fees and lack of service” in the BRW Fast Franchise edition concerning the conduct and services of Franchise Central (Australia) Pty Ltd and its Director and employees.
By reproducing the text in the FCA Update, the FCA did not intend to support, endorse or make any comment on the views expressed by the author of the text or the article in the BRW Fast Franchises edition itself.
The text was immediately removed from the FCA Update upon the matter being drawn to the FCA’s attention.
The FCA apologises for any embarrassment caused."
Director of Franchise Central, Mary James says, "a lesson was learned by the FCA in this case".
